Statutory information obligations and explanations

We manage this insurance contract in agreement with the responsible insurer and in cooperation with Strategic Alliances Financial Services AG, based in Zurich

ABES Group AG acts as an agent for this insurance contract and undertakes to exclusively serve your interests as a client. There is no independent brokerage contract within the meaning of OR 412 ff. between ABES Group AG and the insurance companies, pension funds and other contractual partners involved. As a result, ABES Group AG undertakes an exclusive duty of loyalty towards you.

Within the scope of this contractual relationship, ABES Group AG undertakes to take all precautions for the purpose of Avoidance of conflicts of interest  to have undertaken.

ABES Group AG is compensated for the provision of its services with an administration fee paid by Strategic Alliances Financial Services AG. This management fee is set out in the document Disclosure obligation in accordance with ISA Art. 45b is declared in detail in its amount and nature and amounts to 11% of the net annual premium paid.

In order to compensate us for our services, you waive today and in the future the right to pass on the administrative fees arising from this contract.

In doing so, you confirm that you were informed of the scope and amount of the administration fees before the contract was concluded. ABES Group AG further undertakes to provide full and detailed information on the administrative fees incurred at any time upon request.

You undertake to inform ABES Group AG immediately and on an ongoing basis of any changes in risk, significant changes that could have an impact on the continuation of the contract or on a suspected change in premiums, as well as any loss events that have occurred, and to provide all necessary documents, unless these have already been reported directly to the insurer. ABES Group AG will rely on this information and documentation when fulfilling the contract.

Data protection:

ABES Group AG attaches great importance to data protection within our Group. We are aware of this responsibility and handle all data with the utmost care. We use your data to ensure that contracts are concluded, fulfilled, terminated and extended and to enforce your claims arising from the contract, including your legal claims. As a result, we have extensive insight into your contractual benefits, details of your claims settlements and the premiums and account statements invoiced.

We use this data in order to be able to fulfill the orderly operation for the management of the order. We endeavor at all times to take all precautions to ensure the best possible detection, prevention and elimination of misuse of our products, services or infrastructure. We may also use your data to improve, develop or expand our services, products, their user-friendliness and our support.

The data resulting from the contract documents and the processing of the contract will be forwarded to the insurance company concerned. The insurance company uses this data in particular to determine the premium, to clarify the risk, to process insurance claims and for statistical evaluations. The data is stored physically or electronically.

The insurance company may forward data to the extent necessary to third parties involved in the processing of the contract in Switzerland and abroad, in particular to co-insurers and reinsurers, as well as to domestic and foreign companies in its group for processing. In the event of suspected financial or documentary offenses and in the event that the insurance company withdraws from the contract due to fraudulent substantiation of an insurance claim (Art. 40 VVG), a report may be made to the Swiss Insurance Association (SVV) for entry in the Central Information System (ZIS). ABES Group AG only collects the personal data required for the agreed service. ABES Group AG undertakes to take all precautions to comply with the relevant statutory data protection regulations. The data will be treated with absolute confidentiality.

The controller is the legal person who alone or jointly with others determines the purposes and means of the processing of personal data.

Right of cancellation of a concluded contract in accordance with Art. 2a of the German Insurance Contract Act (VVG):

You can revoke your application to conclude this contract or the declaration of acceptance at any time. The withdrawal period is 14 days and begins as soon as you have applied for or accepted the contract. The revocation does not have to be in writing, but only in a form that allows proof by text, i.e. also e-mails (but also SMS, WhatsApp, etc. are sufficient).

Injured third parties may assert claims against the insurance company in good faith despite a revocation. In these cases, however, the policyholder owes the premium.

Education, training and professional qualifications:

In accordance with VAG Art 43, we are obliged to provide our employees with regular training and further education to enable them to carry out their activities. To this end, we have a comprehensive employee promotion and development program which attaches great importance to the provision of professional qualifications. We also confirm that we meet all the requirements laid down by the Federal Council for the training and further training of insurance intermediaries, although there are no appropriate minimum standards.

According to VAG Art. 45 para. 1, let. c., we are also obliged to inform you about how you can find out about the professional qualifications of our employees.

We hereby confirm on our own behalf and on behalf of all employees that we:

  • Inform you transparently and according to the situation about the training status of each individual employee;
  • demonstrate to you the professional qualifications of the employee who comes into contact with you by means of suitable measures;
  • to give you the opportunity to find out more about our training concept at any time;
  • Employees who hold a "Bachelor of Science Risk and Insurance", a diploma as a "Swiss Certified Insurance Specialist", a higher specialist certificate as an "Insurance Specialist with Swiss Federal Specialist Certificate", a diploma as a "Swiss Certified Fund Advisor IAF", a diploma as a "Swiss Certified Financial Advisor IAF" or a diploma as a "Swiss Certified Asset Manager IAF".
